Noviembre de 1999 La Asamblea Nacional de Nicaragua aprobó el pasado 20 de octubre, a pesar de una fuerte oposición por parte de amplios sectores de la sociedad civil nacional, legislación sobre protección de variedades vegetales (PVP) para satisfacer enormes presiones por parte de los EEUU, y cumplir con los requisitos para solicitar adhesión al convenio de la Unión para la Protección de las Variedades Vegetales (UPOV según siglas en inglés). La PVP ha sido relacionada repetidas veces con la apropiación de la biodiversidad nacional por intereses extranjeros, una menor seguridad alimentaria y como un impedimento al desarrollo agrícola sostenible. Antecedentes Tal como ha sucedido en otros países latinoamericanos, en enero de 1998 se firmó un acuerdo bilateral entre EEUU y el ejecutivo nicaragüense ?acerca de la protección de los derechos de propiedad intelectual?a fin de promover relaciones económicas y de otra índole.? En el acuerdo el gobierno de Nicaragua se compromete a adherirse sin demora a una serie de convenios sobre la propiedad intelectual, entre ellos al de la UPOV, ya fuese en su versión del 78 o la del 91. De manera incidental, durante una reunión convocada por el Ministerio del Ambiente y Recursos Naturales (MARENA), en agosto de 1998, varias organizaciones se enteraron de que el gobierno de Nicaragua tenía la intención de adherirse a la UPOV. Debemos señalar que aunque Nicaragua ya estaba comprometida por su pertenencia a la Organización Mundial del Comercio (OMC) a adaptar su legislación sobre los derechos de propiedad intelectual (DPI) a las normas de los Acuerdos de Propiedad Intelectual Relacionados al Comercio (TRIPS según siglas en inglés), disponía de un plazo para estudiar todo tipo de opción hasta 2000. Por lo tanto, estamos antes un caso de presión bilateral que va más allá de los compromisos, ya onerosos, adquiridos bajo la OMC. Primera ronda: no a los transgénicos, sí al CDB El 19 abril de este año el Presidente de Nicaragua, Sr. Alemán Lacayo, envía un proyecto de ley al Secretario de la Asamblea Nacional solicitando que se apruebe bajo trámite de urgencia una ley de PVP, ya que ?Nicaragua es Estado Miembro del Convenio de la UPOV y por lo tanto signataria del Convenio.? Las ONGs ecologistas, representantes de universidades y organizaciones indígenas, a través del Foro Nacional de Biodiversidad (FOROBIO), reaccionan con un comunicado ante la obvia falsedad de algunos de los argumentos presentados a los diputados -- Nicaragua no era ni es todavía miembro de la UPOV -- y la pretensión de aprobar una legislación trascendente sin ningún tipo de discusión pública. Esa intervención detuvo la tramitación urgente de la legislación, y FOROBIO presentó versiones alternativas sobre muchos de los artículos ante la Comisión de Medio Ambiente. El resultado fue un dictamen favorable a una versión de ley que incluía algunas de las propuestas de la sociedad civil. Entre los elementos introducidos destacan: la exclusión de las variedades transgénicas (explícitamente mencionadas en la versión presidencial, aunque Nicaragua carece de comisión de bioseguridad), ampliación del derecho de los agricultores al uso de la cosecha, registro ante el ministerio de agricultura para garantizar la soberanía nacional sobre el recurso genético, la sintonía con el desarrollo de normas sui generis para la protección de variedades vegetales bajo el artículos 27.3(b) de los TRIPS, y la subordinación de la legislación sobre PVP al Convenio sobre la Diversidad Biológica (CDB). Segunda ronda: EEUU y UPOV no permiten vacilaciones A pesar de las mejoras introducidas al proyecto de ley sobre UPOV, crece en Nicaragua la preocupación ante lo que ya se entiende es una estrategia para permitir la privatización de los recursos biológicos y los conocimientos tradicionales del país. Otros actores, tales como organizaciones religiosas, representantes de la medicina tradicional, cooperativas agropecuarias, federaciones de mujeres, los consumidores y científicos sociales, comienzan a movilizarse para detener la aprobación de la ley de PVP. La prensa del país se hace eco de la discusión. Por otro lado los intereses pro UPOV comienza una contraofensiva a favor de la ley según presentada por el ejecutivo, la cual estaba redactada para cumplir con la versión más restrictiva del UPOV 91. La Comisión de Medio Ambiente de la Asamblea Nacional se apoya en sectores científicos y técnicos cercanos al gobierno que utilizan argumentos retóricos sobre la necesidad de aumentar la producción agrícola y propiciar una capacidad técnica de punta. Ante la misma Comisión el Director de Propiedad Intelectual del Ministerio de Industria, Fomento y Comercio (MIFIC) informó sobre amenazas recibidasde parte de los EEUU sobre una posible exclusión de Nicaragua de la Iniciativa de la Cuenca del Caribe, si no se cumplía con la aprobación de la legislación tipo UPOV. También aparece en escena un asesor sobre propiedad intelectual actuando a nombre del MIFIC, pagado por la USAID, además de la asesoría de otros ?expertos? traídos de Colombia, Uruguay y EEUU. La embajada de los EEUU invitó a los legisladores miembros de la Comisión de Medio Ambiente a una reunión para discutir la legislación pendiente. Además, según el asesor especial sobre propiedad intelectual del MIFIC, la oficina de la UPOV había indicado que no sería aceptada una ley -- como la dictaminada en julio -- con artículos que excluyeran a los transgénicos ni que planteara una subordinación explícita al Convenio de la Diversidad Biológica. En un documento distribuido a los diputados por funcionarios del MIFIC en la Asamblea Nacional se argumentó falsamente -- los PVP de por sí son una modalidad de derechos de propiedad intelectual -- que ?los derechos de propiedad intelectual nada tienen que ver en cuanto al uso y comercialización de semillas.? El documento continua diciendo que ??en cuanto a técnica jurídica si mañana un artículo se opone a otros artículos de una nueva ley, entonces ese artículo queda derogado,? en una muestra de poca seriedad hacia los compromisos internacionales previamente adquiridos por Nicaragua bajo el CDB. Entre el 19 y el 20 de octubre se debate en el pleno de la Asamblea Nacional la legislación de PVP, siendo la misma aprobada en su versión más dura, a pesar de una fuerte y bien argumentada oposición parlamentaria. Tercera ronda: a buscar justicia en los tribunales Ante lo que muchos sectores civiles consideran un atropello, pronto serán radicados varios recursos de amparo ante la Corte Suprema de Justicia por inconstitucionalidad, violaciones a la Ley General de Medio Ambiente y contradicciones con los compromisos adquiridos bajo el Convenio de Diversidad Biológica. Además de las acciones legales, comenzará una amplia campaña de educación de amplios sectores de la sociedad nicaragüense, para así promover la movilización y la resistencia en la defensa de los recursos biológicos y el conocimiento tradicional. Otro aspecto es reclamar la creación de mecanismos legales sobre bioseguridad en el País. Las organizaciones que han estado activas en la campaña sobre la legislación UPOV en Nicaragua han decidido solicitar apoyo internacional para que se le envíen cartas a las principales autoridades del país en apoyo de sus reivindicaciones. Solicitan que las cartas se hagan llegar a las siguientes autoridades del País, según el modelo que se incluye más adelante. Es imprescindible conseguir la derrota de esta ley y que Nicaragua retire su solicitud, aún pendiente, de entrada a la UPOV. Nos consta que esa legislación fue aprobada a pesar de una fuerte oposición en la Asamblea Nacional, y por parte de amplios sectores de la sociedad nicaragüense: universitarios, científicos, ecologistas, religiosos, consumidores, indígenas y cooperativas agropecuarias. La mencionada legislación ha sido aprobada para cumplir con los requisitos de acceso como miembro de la Unión para la Protección de las Obtenciones Vegetales -- UPOV. Hasta hace pocos años la UPOV era sencillamente un club de países industrializados. En años recientes muchos países se han visto presionados -- tanto en forma bilateral desde los EEUU como por la misma UPOV -- a implementar legislación para la protección de las variedades vegetales (PVP) como una manera de garantizar la expansión de modelos agrícolas que solo favorecen a los países ricos y a las transnacionales, a la vez que perjudican los intereses nacionales, desde los agricultores y ganaderos hasta los campesinos e indígenas. No existe ninguna obligación para que Nicaragua apruebe legislación PVP según los criterios de los países industrializados, ni para solicitar adhesión a la UPOV. Los acuerdos TRIPS, bajo su Articulo 27.3(b), otorgan a Nicaragua un plazo hasta enero de 2000 para elaborar una legislación sui generis sobre las variedades vegetales. Sin embargo, los miembros de la OMC están revisando este articulo y los paises en vía de desarrollo han pedido su aplazamiento. Entendemos que aprobar ahora una legislación de tipo UPOV puede perjudicar, en vez de beneficiar, el desarrollo económico y la soberanía alimentaria de su País. En apoyo a los sectores nicaragüenses que se han expresado a favor de una Nicaragua libre para establecer sus propias reglas para la producción agrícola, la protección de los conocimientos y prácticas tradicionales y la garantía de un desarrollo sostenible, y la soberanía alimentaria; respetuosamente le solicitamos que Nicaragua considere otras opciones para la protección de sus derechos, tales como las opciones de los Derechos Comunitarios Intelectuales, el desarrollo de la de la Diversidad Biológica y el Compromiso Internacional sobre los Recursos Fitogenéticos para la Alimentación y la Agricultura de la FAO. Por lo tanto, solicitamos que la Ley de Protección para las Obtenciones Vegetales sea retirada, que Nicaragua cancele su solicitud de entrada a la UPOV, y que a su vez se promueva el desarrollo de la agricultura sostenible, los derechos colectivos intelectuales y los derechos de las comunidades campesinas e indígenas, y que su País promueva la no privatización de todas las formas de vida y la exclusión de la biodiversidad del Acuerdo TRIPS. DATE: November 1999 ORGANISATIONS FIGHTING UPOV IN NICARAGUA APPEAL FOR INTERNATIONAL SUPPORT by Magda Lanuza et al. November 1999 On 20 October 1999, the National Assembly [Parliament] of Nicaragua adopted a plant variety protection (PVP) law under tremendous pressure to satisfy both the United States and the requirements for accession to the Union for the Protection of New Varieties of Plants (UPOV). The National Assembly approved the legislation in spite of strong opposition from a broad section of Nicaragua's civil society. The PVP law was repeatedly denounced as an instrument which will facilitate the appropriation of Nicaragua's biodiversity by foreign interests, increase food insecurity and undermine sustainable agricultural development. Background In January 1998, the Nicaraguan government -- like many other Latin American countries -- signed a bilateral agreement with the United States on the protection of intellectual property rights...in order to promote economic and other relations. In the agreement, the Nicaraguan government promised to accede, without delay, to a series of international treaties on intellectual property. The UPOV Convention, be it in the form of the 1978 or the 1991 Act, was among these. By chance, during a meeting organised by the Ministry of the Environment and Natural Resources (MARENA) in August of 1998, several organisations learned that the Nicaraguan government had committed itself to join UPOV. Even though Nicaragua, as member of the World Trade Organisation (WTO), was already obliged to adjust its intellectual property laws in compliance with the WTO Agreement on Trade Related Aspects of Intellectual Property Rights (TRIPS), the deadline for examining the widest range of options was still some time away (2000). For this reason, Nicaragua's story is a case of bilateral pressure to go beyond international obligations, which are already heavy, acquired under WTO membership. Round One: transgenics out, CBD in On 19 April 1999, the President of Nicaragua, Aleman Lacayo, sent a draft PVP bill to the Secretary of the National Assembly requesting its adoption under urgency procedures on the grounds that Nicaragua is signatory to and member state of the UPOV Convention. Environmental groups, representatives of the academe and indigenous peoples' organisations which participate in the National Biodiversity Forum (FOROBIO), issued a communique alerting the national Assembly to the false arguments that the government was presenting -- Nicaragua was not and is still not a member of UPOV -- and to the serious implications of adopting such far-reaching legislation with no manner of public discussion. This intervention disrupted the urgency procedure, and FOROBIO was then able to present alternative versions for many of the bill's provisions to the Environment Committee. As a result, the National Assembly approved a first reading of the bill, which included several of the amendments presented by civil society. Among these were: * the exclusion of transgenic varieties (these were included in the government's original draft of the bill, even though Nicaragua does not have a Biosafety Committee) * broadening of the farmers' exemption to cover the use of the harvest * a registry under the Ministry of Agriculture to guarantee national sovereignty over genetic resources * a linkage with the development of sui generis laws for the protection of plant varieties under Article 27.3(b) of TRIPS * subordination of the PVP law to Nicaragua's rights and obligations under the Convention on Biological Diversity (CBD) Round Two: US and UPOV reject the modifications In spite of these improvements to the draft law, concern in Nicaragua only grew stronger as it became clear that the strategy behind the law was to allow for the privatisation of the country's biodiversity and traditional knowledge. Other social groups such as religious groups, practitioners of traditional medicine, farmers' cooperatives, women's' federations, consumers movements and social scientists started mobilising to stop the adoption of the PVP bill. In the meantime, the national press echoed the debate. On the other side, the pro-UPOV forces initiated a counteroffensive in favour of the government's original draft, which had been drawn up to comply with the restrictive terms of UPOV's 1991 Act. The National Assembly's Environment Committee leaned on scientific and technical advice from circles close to the government, which amounted to rhetoric about the need to increase agricultural production and attract the latest technologies. The Director of Intellectual Property under the Ministry of Industry, Promotion and Trade (MIFIC) informed the Committee about threats received from the United States regarding the possible exclusion of Nicaragua from the Caribbean Basin Initiative if the country did not approve UPOV-compliant legislation. A special advisor on intellectual property, allegedly acting for MIFIC but paid by the US Agency for International Development, also appeared on the scene along with other experts sent over from Colombia, Uruguay and the United States. The US Embassy in Managua invited the members of the Environment Committee to a meeting to discuss the pending legislation. According to the special advisor operating under MIFIC, the Secretariat of UPOV had indicated that the provisions excluding transgenic varieties from the scope of the PVP law and those explicitly linking the law to Nicaragua's obligations under the CBD -- both of which were approved by the National Assembly during the first reading of the bill in July -- would be unacceptable to UPOV. Then, in a document distributed to the deputies by MIFIC officials, the government falsely argued that intellectual property rights have nothing to do with the use and marketing of seeds. (PVP is a form of intellectual property right.) The document went on to assert that ...technically speaking, if a provision in force today conflicts with a provision adopted tomorrow, today's law becomes obsolete, demonstrating a lack of seriousness towards Nicaragua's international obligations under the CBD. On 19 and 20 November, the National Assembly debated the bill in plenary and adopted it in its hard-line version, despite strong and well-argued internal opposition. Round Three: seeking justice in the courts Since many civil societies feel outraged by what has happened, we will soon initiate several motions to disqualify the law at the Supreme Court of Justice on grounds of: unconstitutionality, violations of the General Environmental Law of Nicaragua and contradictions with the country's obligations acquired under the Convention on Biological Diversity. Aside from these legal actions, groups will carry out broad educational campaigns directed at a wide cross-section of Nicaraguan society in order to mobilise resistance and strengthen national defence of biological resources and traditional knowledge. At the same time, we will pressure for the development of legal means to ensure biosafety in the country. The organisations which have been active in the campaign against UPOV legislation in Nicaragua have decided to request international support in the form of letters addressed to the relevant authorities in Nicaragua supporting our demands. We urge you to send letters to the authorities listed further below, along the lines of a model text that we have drawn up. It is vital for Nicaragua to defeat this PVP law and to withdraw its pending application to join UPOV. We are aware that this law was adopted despite strong opposition within the National Assembly and among broad sectors of Nicaraguan society: the academe, scientists, environmentalists, religious orders, consumers, indigenous peoples and farm cooperatives. The legislation was adopted with a view to fulfilling the requirements of accession to the Union for the Protection of New Varieties of Plants (UPOV). Until very recently, UPOV was a club of industrialised countries. However, many developing countries have been pressured -- both by the United States and by UPOV itself -- to implement plant variety protection (PVP) laws as a tool to ensure the expansion of industrial agriculture which only serves rich countries and transnational corporations while it overrides national interests in the South, especially those of farmers and indigenous peoples. There is no international obligation bearing down on Nicaragua to adopt PVP legislation that conforms to the laws of industrialised countries or to join UPOV. The TRIPS Agreement currently grants developing countries until January 2000 to put in place sui generis systems for the protection of plant varieties under Article 27.3(b). However, this provision is under review at WTO and developing countries are collectively seeking its deferment. UPOV-type legislation will only weaken Nicaragua's economic development and national food sovereignty. We support the sectors of Nicaraguan society which have taken the position in favour of national liberty to choose one's own rules for agricultural production, protection of traditional knowledge and practices, the pursuit of sustainable development and protection of food sovereignty. We therefore very respectfully urge Nicaragua to consider other legal options for the protection of its rights, such as Community Intellectual Rights, the development of the Convention on Biological Diversity and the International Undertaking on Plant Genetic Resources for Food and Agriculture of the FAO. In this respect, we ask that the Law for the Protection of New Plant Varieties be withdrawn. We also implore Nicaragua to cancel its application for accession to UPOV. We hope that, instead, Nicaragua may promote the development of sustainable agriculture, collective intellectual rights and the rights of farming and indigenous communities.
